Progressing an approved subdivision

Find information on how to progress your subdivision once your consent is approved, including how to apply to us for section 223 and 224 certificates.

These certificates confirm you have met the conditions of your consent and are needed before records of title will be issued by Land Information New Zealand for your subdivision. 

Before progressing your subdivision, we recommend you:

  • review of your subdivision consent conditions so you fully understand what is required and the timing for completing any of the requirements
  • engage a suitably qualified and experienced professional (surveyor or planner) to manage this process for you, as it can be complex and technical
  • engage other professionals such as engineers, landscape architects and lawyers to prepare information required to meet your conditions.

Your subdivision consent will include two sets of conditions: 

  1. Section 223 conditions
    Setting out information to be prepared and provided to us, often prior to commencing physical works.   This will include the preparation of a survey plan and may include engineering plans, landscape plans or road naming requirements.
  2. Section 224 conditions
    Setting out details of how any physical works must occur.  These may be utility service connections, access formation or landscape planting.  It can also include any certification required in carrying out the work, as well as any legal documentation required (e.g. consent notices, covenants, easements etc) that are required to be registered against the record(s) of title.

s223 Certificate

A Section 223 certificate confirms that the survey plan prepared is the same as the scheme plan approved by Council as part of the subdivision consent and that all 223 conditions have been met.

You have 5 years from the date of granting of the subdivision consent to obtain section 223 certification.

Step 1.Prepare and obtain documentation

You will need to prepare and obtain any document that is required to meet your Section 223 conditions.

This includes having a registered surveyor prepare a survey plan that matches the scheme plan approved as part of your subdivision consent. The survey plan must also include any amalgamation conditions, easements and covenants required by the subdivision consent.

In addition, this may include:

  • detailed engineering plans
  • other detailed information required to meet section 223 conditions, such as a landscape plan
  • documentation from telecommunication and electricity providers
  • approval of a road name for a proposed road

Any detailed engineering plans required as a condition of your subdivision consent will need to be approved by our Development Engineers prior to submitting your application for a 223 certificate.

Where a condition requires a road naming application to be made for a road proposed as part of your subdivision, this needs approval via a road naming application prior to submitting your application for 223 certificate. You will need to identify three potential road name options as part of this process.

Step 2.Lodge survey plan with LandOnline

You will need to engage a surveyor to lodge your survey plan with LandOnline prior to submitting your application for a 223 certificate.

Step 3.Complete application

Download and save a copy of the form to your computer.   Open the application form on your computer, fill it in and save to your computer again.

Step 4.Submit to us

You can submit your application and all documentation required to demonstrate your section 223 conditions have been met via email, post or bring it into one of our customer service centres.

Step 5.Process application

We will check your application and confirm all 223 conditions have been satisfied by the documentation you have provided.

If the application is deemed to be incomplete, it will be returned to you with a letter advising of the additional documentation required. You can re-submit the application once you have prepared all required documentation.

Within 10 working days of receiving your complete application, and once we are satisfied that all 223 conditions have been met, we will sign off the survey plan via LandOnline.

We will send you written notice of this process having been completed, along with a copy of the section 223 certificate and approved survey plan.

Step 6.Lodge Survey Plan with LINZ

Once we have signed off the survey plan via LandOnline, you will need to engage your solicitor to lodge the surveyor plan with LINZ.

LINZ will check the plan and approve as to survey.  Where the plan does not meet LINZ requirements, they will requestion your surveyor to have the survey plan corrected prior to approval.

Step 7.Pay fees

An interim invoice may be charged at this stage for reviewing and approving the survey plan, checking compliance with conditions or for any inspections we make. Alternatively, fees will be charged at the 224 certificate stage.

Fees will be charged to cover the actual and reasonable costs of us processing your application.

s224 Certificate

A section 224 certificate is approval by us, that all 224 conditions of the subdivision consent have been met. This includes payment of fees, approval of legal documents, and completion of all the physical works.

An application for a section 224 certificate needs to be lodged with us. 

This stage of the subdivision can be processed at the same time as the section 223 certificate. If not, it must be lodged with Land Information New Zealand (LINZ) within three years of the date of approval of the section 223 certificate, otherwise the original subdivision consent will lapse.  

Step 1.Complete all physical works

Prior to applying for your 224 certificate you will need to complete all physical works associated with the subdivision. This will often include:

  • engineering works
  • earthworks
  • provision of power connections
  • other works required by conditions of consent, such as landscape planting.

Step 2.Prepare and obtain documentation

You will need to prepare suitable evidence to show us that all the physical engineering works have been completed in accordance with the approved engineering plans.  To do this, you will need to engage a suitably qualified surveyor or engineer to check, test and certify completion of all works.

In addition, you will need to prepare or obtain any other documentation required to meet your section 224 conditions. This may include:

  • the preparation of legal documents such as consent notices, covenants, or easement instruments by your lawyer
  • confirmation from your landscape architect that all landscaping has been completed in accordance with your approved landscape plan.

Step 3.Complete application

Download and save a copy of the form to your computer.   Open the application form on your computer, fill it in and save to your computer again.

Step 5.Process application

We will check your application and confirm all 224 conditions have been satisfied by the documentation you have provided.

Within 10 working days of receiving your complete application, and once we are satisfied that all 224 conditions have been met, we will raise our final invoice.

Step 6.Pay fees

All outstanding charges must be paid including any development contributions, to allow us to issue the section 224 certificate. 

Fees will be charged to cover the actual and reasonable costs of us processing your application.

Step 7.Receive copy of certificate

Once payments for invoices have cleared, we will approve the section 224 certification via LandOnline.

We will send you written notice of this process having been completed, along with a copy of the certificate.

Step 8.Apply to LINZ for Record(s) of Title

Once you receive the written notice and certificate, you will need to engage a solicitor to make an application to Land Information New Zealand (LINZ) for record(s) of title for each of the allotments created by your subdivision.
