Plan Change 1: Natural Hazards

Whangarei District Council gives notice pursuant to Clause 7 of the First Schedule of the Resource Management Act 1991 that it has prepared a summary of decisions requested by persons making submissions, on proposed Plan Change 1 Natural Hazards (PC1) to the Whangārei District Plan.

The Plan Change proposes to replace the existing Natural Hazards chapter in the District Plan with a new Natural Hazards chapter and new rules for subdivision and earthworks in hazard prone areas.

Key features of the proposed Plan Change include:

  • objectives, policies, and rules which apply to all natural hazards.
  • policies, rules, and maps relating specifically to land instability, mining subsidence, flooding, coastal erosion, and coastal flooding hazards.
  • inserting new definitions to define each hazard overlay and a definition of vulnerable activities to cover land use activities which are more susceptible to the effects of natural hazards.
  • amendments to other parts of the District Plan to use consistent terminology in relation to the management of natural hazards.

The scope of Plan Change 1 does not include amendments to the District Plan Area Specific Maps.

Further submissions

No later than 20 working days after the date on which this public notice is given, any of the following persons may make a further submission on the plan change:

  • Any person representing a relevant aspect of the public interest; and
  • Any person who has an interest in the proposed plan change greater than the interest that the general public has; and
  • Whangarei District Council.

Further submissions closed at 4:00pm on Wednesday, 20 September 2023.

A further submission given must be limited to a matter in support of or in opposition to the relevant submission made under Clause 6 or 6A to Schedule 1 to the Resource Management Act 1991.

The person making a further submission must within five (5) working days of making the further submission to Council, serve a copy of the further submission on the submitter to which the further submission relates.

The further submission must be made in the form prescribed in Form 6 of Schedule 1 to the Resource Management (Forms, Fees, and Procedure) Regulations 2003.
